What information is collected?
Restaurant.com is the sole owner of the information collected on its Website. We will not sell, share or rent this information to others in ways different from what is disclosed in this policy, without first obtaining your consent.
Restaurant.com may collect information when you visit or use our Website. We also may automatically record information on our server logs from your internet browser, such as your IP address, page requests and cookie information. This information may be used to customize the content you see when you use our Website. This information is generally used to fulfill your requests, to contact you and to customize and improve your experience with Restaurant.com.
IP Addresses
Every computer connected to the internet is given an IP address. We use IP addresses to analyze trends, administer the Website, track users' movement and gather broad demographic information for aggregate use. Registered Users
When a customer joins Restaurant.com we collect information to provide customized service, to deliver dining certificates and other communications via email and to allow our customers to access and manage their Restaurant.com purchases and requests. (Please note that dining certificates are delivered via email so a valid email address is required.) We collect some or all of the following information:
Full Name, Email Address, Password, Address, City, State, Zip Code, Phone Number, Birthday, Anniversary, Restaurant Dining Certificate Purchases, Restaurant.com Gift Certificate purchases, Take-out Orders, Reservation Requests and Customer Service Correspondence
Information required to become a registered user includes name, password, email address and full home address. Optional information includes email preferences, birthday, and anniversary. All users have the option not to receive emails from Restaurant.com (and/or from Restaurant.com restaurant partners), other than automated service messages concerning an order, request or dining survey. If you would like to change your email preferences please visit “My Account.” Here you will be able to manage your email preferences, update your contact information and view and track your orders and requests.
Some of our services may be offered in conjunction with partner companies, affiliates or other companies or websites with which we work. In order for us to provide these services to you, it may be necessary for us to share your personal information with one of such entities. These trusted partners are not allowed to use personally identifiable information except for the purpose of providing these services. If you do not want your data to be shared, you can choose not to allow the transfer by not using that particular service.
Online Reservations
If you choose to make an online reservation using Restaurant.com it is required that you are a registered user of Restaurant.com and you will need to provide your name, phone number, email address, requested reservation date and time along with the number of people in the party. (For best results, make your reservation during the restaurant's regular hours of operation.) The restaurant has the option to contact you about the reservation; this call may be recorded for training and quality control.
Online Take-out and/or Delivery
If you choose to order online take-out and/or delivery using Restaurant.com, it is required that you are a registered user of Restaurant.com and you will need to provide your name, phone number, email address and credit card information. (The restaurant has the option to contact you about your order). Restaurant.com will not charge your credit card. Your credit card information will be provided to the restaurant to be charged. This information is collected in advance to prevent fraudulent orders. When placing an order for delivery, you will need to agree that you are in fact within the delivery area of the restaurant.
Your Restaurant.com Account (Correction/Updating Personal Information)
You may access your account at http://www.restaurant.com/my-restaurant.asp. Here you will be able to manage your email preferences, update your contact information and view and track your orders and requests. Please note: This system is a self-management tool—in other words, a means for you to keep track of and record your purchases. For privacy reasons, Restaurant.com will not mark or indicate certificate usage, but has offered this system as a simple way for you to keep track of your purchases.
Email Preferences/Opt-out
We send out two types of emails ¾ transactional and promotional. Our users are given the opportunity to "opt-out" of receiving promotional communications from Restaurant.com by updating their email preferences in your “My Account” or by sending an email with the information to update to info@restaurant.com.
Transactional emails
Transactional emails include registration, confirmation, account update, customer service, restaurant surveys and other communications that Restaurant.com needs to reach our customers concerning their account, requests or purchases. This does not include any promotional communications, such as sales or specials. You may not opt out of these transactional communications. These emails will all be sent from a Restaurant.com address, for example lastname@restaurant.com or halfprice@restaurant.com.Promotional emails
Promotional emails are sent to customers who opted into our email list. This option is provided when registering with Restaurant.com. These emails share exclusive sales and offers with our users and will be sent from restaurant_com@emailrestaurant.com.If you are having trouble receiving these emails first check your spam/junk folder. Occasionally emails can mistakenly end up in your spam/junk folder; it may help to add "restaurant_com@emailrestaurant.com" to your address book. You can also email info@restaurant.com and have us check to make sure you are still on the list, be sure to include your email address.
If you have opted-in to receive promotional emails you may opt out of these promotional emails at any time by updating your email preferences in “My Account” or by sending an email with their request to info@restaurant.com.
Customer Service Correspondence
If you send us correspondence, including emails and faxes, we may retain such information in the records of your account. We may also retain customer service correspondence and other correspondence from Restaurant.com to you. We retain these records in order to measure and improve our customer service, and to investigate potential fraud and violations of our Terms of Use Agreement. We may, over time, delete these records, if permitted by law.
As a general rule, except as described in this privacy policy, we will not disclose any of your personally identifiable information except when we have your permission or under special circumstances (such as when we believe the law requires it). We may disclose or share aggregated demographic information with certain partners, affiliates and advertisers, however, except as described above, this is not linked to any personal information that can identify any individual person or company. In addition, Restaurant.com may disclose account or other personal information when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with Restaurant.com's rights or property, other Website users or anyone else that could be harmed by such activities.
Restaurant.com may also release personal information to appropriate governmental authorities under the following circumstances:
- Where release is required by law (for example, a subpoena) or regulation, or is requested by a government agency conducting investigations or proceedings; or
- Where our records indicate a company may be engaged in fraudulent activity or other deceptive practices that a governmental agency should be made aware of.
As with any other business, it is possible that Restaurant.com in the future could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the information maintained by Restaurant.com, including customer account information, but would continue to be bound by this Privacy Policy unless and until it is amended as described herein.
SurveysFrom time-to-time Restaurant.com may request information from users via surveys (e.g. within the Feedback section of the Website). Participation in these surveys, to the extent we run any, is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and shipping address) and demographic information (such as zip code and age level). For purposes of allowing targeted marketing restaurant owners are provided with access to the name and email information for each purchaser of a Restaurant.com dining certificate for their restaurant once such certificate has been validated. After you have used your dining certificate you may be invited to take a survey to provide feedback to the restaurant about your dining experience. These survey results will be provided to the restaurant. If you choose to leave added comments the restaurant will be provided with your name and email address along with your comment so they may follow-up if necessary. The Restaurant.com team takes security seriously and takes numerous precautions to protect our customer’s personal information.
